TERMS AND CONDITIONS

The following Terms and Conditions rules the access to and the use of the content by the users (hereinafter, the “User” or “Users”) of the website www.runtheworldapp.com (hereinafter, the “Website”) and the related applications for mobile devices (hereinafter, the “Apps”). Run the world S.r.l., a company registered under Italian Law with registered office in Giudecca (VE), Campo San Cosmo n. 624, Italy, TAX ID and VAT registration No. 04440930271 (hereafter “Run The World”) owns and runs the Website and the App, for the providing of contents and services under the trademark “Run The World - Sightseeing in Movement ®”.

Please read these Terms and Conditions carefully before enjoying the contents and the services provided through Website and Apps. By using Run The World you are agreeing to be bounded by these Terms and Conditions.

1. Definitions.

1.1 In addition to the conditions stated by this document, the terms named here below have the meanings here explained:

1. Ambassador. Means a User who uploads new running routes, together with photos, videos, description of the route and exercise regimens, comments, or monuments, point of interest and other content about the city in which the running route is set to the Platform.
2. Platform. Means the “Run The World” Website and App.
3. Services. Means all the services provided by the Website and App to the Users, which are:

• providing the Users with the best routes to run in a specific location;
• offering guidance, recommendations and suggestion concerning monuments, point of interest of the city in which the running route is set, so that the Users       can independently discover a tourism destination while running;
• offering a Platform where the User can ask and received advices, and share route to run in several city in the world;
• get inspired by the contents such as map routes, photos, videos and other details.

d. User. Means any person who register to the Website or the App and has accepted the Platform’s:

• Terms and Conditions;
• Privacy Policy.

e. User’s Account. Means the User personal area, where all his data are collected and he can manage his running routes. The creation of an account is conditioned to the reading and acceptance of and compliance with these Terms and Conditions.

2. Scope of this Agreement.

2.1. These Terms and Conditions govern the Services offered through the Platform. By using the Platform, Users agree to these Conditions and therefore Run The World invites everybody to them carefully. These Conditions may, at any time, be unilaterally updated and/or amended by Run The World.

3. Registration and Account.

3.1. In order to register and create a valid account, a User is required to:

1. truthfully complete the required fields on the registration form, in which personal data such as name and email address are requested;
2. accept these Terms and Condition (including our Privacy Policy) communicated during the registration procedure on the Platform.

3.2. Both the username and password used to access the Platform (usually username, password and e-mail used to access said account -collectively the "Access Keys") are strictly confidential, personal and non-transferable data. The User agrees not to disclose these access keys or make them accessible to third parties. Run The World cannot guarantee the true identity of all registered Users. The User agrees not to disclose these access keys or make them    accessible to third parties. Since Run The World cannot guarantee the identity of registered users, the User shall be solely liable for the use of Access Keys by third parties, including the Platform’s results or any other action that is carried out by using the Access Keys.

3.3. Once registration is completed, any User can access his profile and complete and/or edit as it deems appropriate, provided it complies with these Terms and Conditions.

4. User Obligations.

4.1. Users guarantee that all data concerning the identity and legitimacy provided to Run The World on their registration forms of the Platform are truthful, accurate and complete. Users also commit to keep the data updated at all times. In the event that the User provides any false, inaccurate or incomplete data or if Run The World considers that there are grounds to doubt the truthfulness, accuracy and completeness of these and Run The World may deny access to
the Platform or any of its Services or likewise cancelling the User’s Account.

4.2. Users undertake to refrain from using their Account and the remaining content and Services of the Platform, for purposes or effects that are: (a) other than sharing photos, videos, and other content on running routes or monuments and point of interest of the city in which the running route is settled, or (b) unlawful or harmful to the rights and interests of others, or in any way damage, disable, affect or impair the Platform, its contents and Services.

4.3. Users hereby agree to (including but not limited to):

1. Provide accurate and updated information, in any communication with Run The World or any content or information communicated on the Platform;
2. Not use false identities or impersonate others in the use of the Platform or using any Services thereof;
3. Not use the Platform for illegal or unauthorized purposes;
4. Not publish on the platform any comments photographs or other information that is illegal, racist, xenophobic, obscene, pornographic, abusive, defamatory, misleading, fraudulent or otherwise contrary to morality or public order.

4.4. Access to the Platform may be refused by Run The World to those Users who, in any manner, violate the obligations of these present Terms and Conditions or any other provision set forth in the Platform, such as (but not limited to) the Privacy Policy.

5. Responsibility for posting content on the Run The World Platform.

5.1 An Ambassador may upload new running routes, together with photos, videos, description of the route and exercise regimens, comments, or monuments, point of interest and other content about the city or other location in which the running route is set (the “Content”) to the Platform. Ambassadors retain all rights to their Content posted on Run The World. By making the Ambassador’s Content available on the Platform he grants to Run The World a nonexclusive, transferable, sublicensable, worldwide, royalty-free license to use, copy, modify, publicly display, publicly perform and distribute his Content only in connection with operating and providing the Services.

5.2 Ambassadors are responsible for their Content posted. The User represents and warrants that he has all rights necessary to grant to Run The World a license to use the Content described in these Terms and Conditions. The User also represents and warrants that the Content and its use on the Platform will not: (a) infringe, misappropriate or violate a third party’s patent, copyright, trademark, trade secret, moral rights or other intellectual property rights, or rights of publicity or privacy; (b) violate, or encourage any conduct that would violate, any applicable law or regulation or would give rise to civil liability; (c) be fraudulent, false, misleading or deceptive; (d) be defamatory, obscene, pornographic, vulgar or offensive; (e) promote discrimination, bigotry, racism, hatred, harassment or harm against any individual or group; (f) be violent or threatening or promote violence or actions that are threatening to any person or entity; or (g) promote illegal or harmful activities or substances.

6. Responsibility of Run The World.

6.1 Run The World declines any responsibility for service interruptions, connection errors, unavailability or deficiencies in accessing Internet services or interruptions of the Internet or for any other reason beyond its control.

6.2 Run The World declines any responsibility for any security error may occur, for damages to the Users’ IT system (hardware and software), or to documents and or file stored wherein, caused by:

1. uploading viruses, malware and bugs, in the User's computer or mobile used to connect to the Services and content of the Platform;
2. browser’s malfunction;
3. use of non-updated version of the App.

7. Limitation of liability.

7.1 Run The World’s goal is to provide runners with the best routes to run all over the world, but it makes no endorsement or warranty of any kind about the accuracy of all routes. Run The World does not guarantee that all the routes provided are accurate, reliable, effective or up the date.

7.2 Run The World is not responsible for damages or injuries incurred due to inaccurate or outdated routes, or through elements outside of Run The World's control, including but not limited to construction, new roads, weather, time of day, or other people.

7.3 The User undertakes to use the Services giving due consideration to the environment and avoiding to put himself at risk of injury or harm, and acknowledges that reliance on any such information shall be at his sole risk.

7.4 Run the World is not responsible for any accident, damages or injury occurred to the runner or User for third party misconducts occurred during the use of the App.

8. Privacy.

8.1 In order to access the Services provided by the Platform, Users are required to read and approve in advance, by clicking on the dedicated icon, the Privacy Policy that sets forth the Services, published on www.runtheworldapp.com/privacy-policy.

8.2 Any information collected by Run The World is subject to the acceptance of Run The World’s Privacy Policy, which is part of these Terms and Conditions.

9. Intellectual Property.

9.1 The Website and App’s format, including web pages, layout, graphics, colors, schemes, tools, the characters and design are protected by legislative decree n. 95/2001. The Platform’s content including the maps, photos, videos, information, functions and software relative to the Platform, are protected by L. 633/1942 (Italian Copyright Law).

9.2 The reproduction of the Platform and its contents, whether in full or in part, is prohibited in any form, without the explicit written approval of Run The World. Run The World claims the exclusive right to authorize or forbid the direct or indirect, temporary or permanent reproduction, in any way or form, whether in full or in part, of the Platform and its contents.

9.3 “Run The World - Sightseeing in movement” is a protected trademark. Users shall refrain from using or reproducing this trademark, in any manner which infringes with the trademark laws applicable in the jurisdiction where the sign is protected.

10. Procedure for account termination.

10.1 Users may unsubscribe from the Platform at any time by sending an email to with the email subject "Unsubscribe" and including in the body of the email username and e-mail when registering on the Platform.

10.2 Run The World may suspend or terminate the User’s Account immediately: (i) if the user fails to comply with any requirement of the Terms and Conditions or (ii) if Run The World discontinues to provide the Services, any time and without stating any cause.

11. Amendments and updates of Run The World’s Terms and Conditions

11.1 Run The World may amend or simply update all or part of this Terms and Conditions. Such amendments and updates will be notified to Users on the Website’s home page an on the App’s Notification Area and will be binding once posted on the Website and App.

12. Severability.

12.1 If any of the clauses contained in these present Terms and Conditions should be considered void such a declaration of invalidity shall not invalidate the rest of the Terms and Conditions, which shall remain valid and effective.

13. Applicable law, settlements and jurisdiction.

13.1 These Terms and Conditions are regulated by Italian law.

13.2 The assigned exclusive jurisdiction for all disputes arising in connection with the application or interpretation of these Terms and Conditions is the Court of residence of the User if residing in Italy. In case the User does not reside in Italy, the exclusive jurisdiction is the Court of Milan, Italy.
